Subdivisions and Land DivisionsThe Land Division Act, Act 288 PA 1967, as amended, regulates platted subdivision and other parcels of land that are split called “land divisions”. Subdivisions and land divisions less then 1.0 acre that utilize on-site water supplies and/or on-site sewage disposal systems must be reviewed and approved by the local health department. The Administrative Rules for the Land Division Act contain the specific requirements for on-site water supplies and on-site sewage disposal systems. CondominiumsCondominiums are regulated by the Condominium Act, Act 59, PA 1978, as amended. Section 71a of The Act requires that condominiums which have on-site water and/or on-site sewage disposal systems must comply with the Administrative Rules for the Land Division Act. Submission of Plans and DataThe developer or proprietor of the project must obtain the services of a qualified and competent consultant to submit data and plans to the local health department substantiating the suitability of the site for construction of on-site water and wastewater systems. District Health Department #2 charges a fee for review of the plans which varies with the size of the project. District Health Department #2 will conduct office and site reviews to be certain the plans and data meet the intent of the act and the rules. If deemed acceptable the Health Department will give a preliminary approval with conditions and restrictions necessary for final approval. Upon submission of required information, the health department will provide a final Health Department approval of the project. | ||
